These Terms and Conditions (“Terms”) govern the provision of services (“Services”) by Phoenix Welding and Fabricating Ltd Inc., with registered address at P.H. Plaza Obarrio A-209, Samuel Lewis Street, Bella Vista, Panama. By accessing or purchasing Services through our website, you agree to be bound by these Terms.
1.2. Services
We offer both consultancy and execution services in the civil and construction sector, organized as follows:
• Civil & Construction
o Consultancy: feasibility studies, site surveys, structural assessments, project planning and management.
o Execution: site preparation, grading, concrete works, structural repairs.
• General Services
o Consultancy: equipment selection advice, logistics planning, labor requirements analysis.
o Execution: equipment rental; transportation; labor supply.
• Specialized Services
o Consultancy: process evaluations, safety and compliance reviews for high-pressure operations.
o Execution: pipe cutting; hydro blasting; industrial vacuuming; aqua milling.
• Welding & Fabrication
o Consultancy: material selection, weld procedure specifications, quality‐control planning.
o Execution: on-site and shop-based welding, metal fabrication, plate work.
All Services are described in detail on our website or in project proposals; any bespoke scope will be agreed in writing.
1.3. Eligibility & Account
You must be at least 18 years old and legally capable of entering into contracts under Panamanian law. To purchase Services, you may be required to register an account and provide accurate, complete information.
1.4. Pricing & Payment
• All prices are shown in Unites States Dollar (USD) and include applicable local taxes.
• Online payments are accepted via credit card (Visa, MasterCard) or other electronic methods. By submitting payment details you authorize us to charge your card or account.
• Payments are accepted from any country. You are responsible for any foreign‐exchange, bank, or processing fees your payment provider may impose.
1.5. Modification of Terms
We may update these Terms at any time; changes take effect upon posting. Continued use of our Services after changes constitutes your acceptance.
1.6. Disclaimers & Limitation of Liability
• We provide consultancy and execution services “as is” and make no guarantees of outcome.
• To the fullest extent permitted by law, our aggregate liability shall not exceed the total fees paid by you in the 12 months preceding any claim.
1.7. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Panama. Any dispute shall be submitted to the jurisdiction of the Panamanian courts in Panama City.
